Introduction
Individual Protections is a service provided to member school districts (local education agencies) in the Desert/Mountain SELPA and Charter SELPA. The Program Manager for Due Process oversees these responsibilities. Inherent to this position is the dissemination of information and initiation of procedures that ensure compliance with all parent/child rights and requirements. These include the availability of parent/child rights notices, equal access to programs and services, correction of identified programs/services concerns, and compliance with mandated timelines for assessment and placement of children.
Due Process is a requirement under the Individuals with Disabilities Education Act (IDEA) that sets forth a regulatory basis for a formal set of policies and procedures to be implemented by schools and districts for children in special education programs. Due Process provides children with disabilities receive FAPE. These policies and procedures are described in the school district's Notice of Procedural Safeguards, otherwise known as Parents' Rights.
